Landlords have a legal duty to assess and control the risk of legionella in their rented properties, under health and safety law. There is no legal requirement for a certificate or for annual testing, and the Health and Safety Executive has confirmed the risk in most homes is low. A professional risk assessment is a straightforward way to meet that duty, document it, and have peace of mind, which is especially useful for HMOs and properties with more complex water systems.
A competent assessor reviews the property's water system, including the cold water tank, pipework, water heater, taps and showers. They look for risks such as stagnant water, debris, and water stored or left at temperatures where legionella bacteria can grow, then set out simple steps to control any risk found.
Legionella bacteria can grow in water systems and cause Legionnaires' disease, a serious and sometimes fatal lung infection. The risk in a typical home is low, but you still have a duty to check. An assessment protects your tenants, supports your insurance position, and gives you documented evidence that you have managed the risk.
